Talked to Bob.
I was asked if we wanted an extra beam for $1800 or engineered trusses $2500. I told them to put in whatever was speced in the original design. I was told that the span was too great for that. I said we might as well go with the engineered trusses as they were much better for only $700. but we were only paying the difference between them and the extra beam as that was the minimum design cost.
Aug 22th. Iain called to say that they would be ready to trench in power on the 4th of Sept.
The water trenching needed to be done before that date as the electrical needs to go overtop of the water. I told him that I had a backhoe arranged to come in on Aug 20th but the backfilling of the house had not been done yet. The next date that the backhoe could come was Sept 15. I told Iain that I was comfortable renting a trencher and running the power lines myself if the electrical could wait until sept 15th, Iain said that was not soon enough as the electrician needed to hook things up early sept at the latest. I mentioned to Iain that I had looked around for a backhoe to rent so that the trenching would be done by the 4th of Sept but I was having no luck finding one. Iain asked that if he found one to rent if I would operate it. I told him that this was not the best scenario as it would likely cost Cary’s trenching less to do the work than the rental of the backhoe but if we needed it done by the 4th it would be the only way it would be done. Iain found a mini backhoe to rent and I operated it for 20 some hours in order to get the water trenched in. This 20 hours would have been better spent removing fencing from the old house, putting up fencing at the new house or a variety of other things but it needed doing before the 4th so I did it.
Sept 2007.
Iain called and suggested that if we want to make our basement more usable... we should rough in radiant heat. The cost to rough in radiant heat would be roughly $1000. We said if it was $1000 we could afford it as we would likely come in under budget on flooring and lighting.

Cary’s trenching comes in to install septic tank and finish trenching off for sewer lines.
Sept 21, 2007 Kevin talked to Iain regarding power trenching or lack thereof. I investigated renting a trencher and performing the work myself as I wanted power to the outbuildings and I did not want to pay the labour rates to dig a trench that I could easily do myself. The trencher at Rona was $115/day to rent and moved fast enough that I could likely get the trenching done in 1 day. Iain told Kevin that under no circumstances should I trench my own power, the electrician will quit if I do the trenching and we do not want that to happen. He also stated that the savings I would see on the cost of the wire if the electrician picked it up would more than offset the cost of town and country’s labour to dig the trenches.
Kevin called around to various electrical places and found that #2 AWG wire would be roughly $7/meter and that we needed roughly 140M of it.
Early October 2007
Tara talked To Iain regarding storage of our belongings. Iain assured us that the basement floor would be completed by the 15th of October and we could store our stuff in the basement of the house. Tara expressed her concerns after talking to the drywallers that if there was no heat in the house that the drywall upstairs would be damaged by the pouring of the concrete slab in the basement. Iain assured us that the electric heaters they installed would more than take care of any moisture problems upstairs and the basement would be sealed off from upstairs, heated from outside by a portable heater.
Kevin called Iain expressing concerns that the electric heaters were very inefficient and that we had concerns with the enormous bill for electricity that was forthcoming should these run for any significant amount of time. Iain assured us that the electric heaters would only be a temporary measure and that the power bill would be picked up by Town and Country homes.

Kevin Talked to a T&C employee regarding the completion of the basement. It was not done and she was not sure what to do with our belongings. She would have Iain call us back.

Tara talked to Iain regarding lack of a place to live and a lack of storage for our belongings. Iain responded to Tara via his employees that we could store our belongings in the centre of the upstairs floor covered with a tarp. There were still windows missing and door locks that did not work. The new move in date was set to Nov 1, 2007, If it was just 2 more weeks we might as well just pay the rental than go through moving things down then up.
In hindsight there were also inadequate teleposts in the basement that would have collapsed under the weight of our belongings.

Trenching for power will be done this week. Kevin asked if we needed to call the utilities before we started digging. a T&C employee said that someone had already taken care of that.

T&C showed up to do trenching. Natural gas line was not marked. After talking to saskenergy they replied that they had failed to stake it because we had no service on the property so they assumed that the land was clear of any natural gas lines. They would have someone out by Friday to get it staked.

Tara. Discussed with Iain that we were having difficulties living where we were and we were assured by Iain that we would be in before the end of Nov.
Nov 23 the new move in date was set to Dec 7, 2007. We decided at this point to spend $200 more to keep our belongings in the trailer as it was just 2 more weeks.
Nov 30 Iain offered the loan of a house for the month of Dec in the North Central region that was the product of a messy split. He was able to get this by agreeing to fix the doors and windows that the spouse destroyed when she left. Also promised at this time was a weekend in a hotel suite to “get away”. He promised that we would be in before Christmas. A heated discussion followed regarding the move of the date again. Iain produced a Gannt chart that detailed the steps needed to be done before completion. The Gannt chart showed the move in date to be Jan 18. After questioning why Iain said before Christmas when the chart said jan 18 Iain said “If you want a date that’s carved in stone, etched on a monument the date is Jan 18, but you will be in before Christmas I guarantee it”
Dec 1.
Tara and Kevin discussed moving into the loaner house from town and country, We decided that it did not make sense to move into a temporary house during the Christmas rush, especially considering that we would be moving into our house in a few weeks. We also decided that if it was just a few more weeks that we would not go through the effort of moving our belongings into the basement and then moving them back upstairs when we actually moved in.
Dec 6th
Kevin sent an e-mail to Iain regarding the latest payment that they were requesting. Town and Country was requesting that we pay up to 75% as we were to pre-paint and that pre-paint was typically the point at which 75% was paid to the builder. I pointed out that pre-paint typically included things like furnace, water heater, basement floor… and that to ask for money for items that were not complete was unacceptable. I also pointed out that the change orders for windows, trusses and radiant heat were not correct. We did not authorize an extra $3200 for windows, $2500 for trusses or $3000 for radiant heat. If he wished to add these extra expenses to our bill that he had better be ready to receive a bill for accommodations and storage fess for our belongings.
Dec 7th
Basement slab was to be poured today but due to a malfunctioning heater the concrete was not done. Kevin noticed at 5PM that the teleposts that need to be cemented into the floor are still the posts that the inspector stated were not large enough.
Dec 10th Basement slab was poured today. The heater is not functioning properly and there were no lights hooked up in the basement. After talking to the cement contractors there was also not enough cement ordered to properly do the floor. Also the lack of lights made it hard to make the floor level.
Dec 15th
Talked with Iain regarding the poor finishing job on the basement floor, there was a large dip at the bottom of the stairs and several dips and humps throughout the basement, did we need to get this corrected before we put up interior walls in the basement. Iain stated that no we would not need to wait, the dips were not that bad, he would bring his leveler out to determine if the floor was good enough to pass the “new homeowners warranty”
Dec 17th Talked to Drywallers we had hired to finish the exterior walls of the basement.
Was told that the cost of the drywall material that he ordered for us for the exterior walls would be roughly $800 but the bill would go to Iain as per the agreement.
In counting there were 26 bags of insulation at the price of $24 per bag (so says Iain), this leaves us with $976 extra to apply to other things as 2400 was included in the contract price for this material. The basement walls required 56 bags of insulation, 30 of which I had to pick up at my expense. I was guaranteed that if I gave the bill to Iain that the cost would be applied as a payment towards the house.

Sent an e-mail to Iain asking for answers to various questions regarding completion…
Iain called back explained that he was very busy, we should expect no better due to the market conditions and did not answer even one of my questions.
Jan 5th
Talked to cement contractor regarding the unevenness of our basement, He told me that he would take $1000 off the concrete bill as the floor was so bad, he also said that it was Iain’s fault due to the lack of lighting/heat and concrete but he felt bad for leaving us with a bad floor. He also said he would come out with a grinder and some mortar to grind off the larger humps and fill in some of the dips. Which he did.

Iain called Kevin regarding failure to order main bathroom fixtures. It was explained that this was a change that had no change order and Iain had no knowledge of it.
The news was that the tub required for the bathroom was not ordered and would take 3 weeks to arrive, if we went with a marble tub, 6 weeks if we went acrylic. This was OK because we had the master bathroom to shower in
Tara later called Iain to express displeasure and unacceptable solution of “using the shower for 3 weeks” and Iain’s solution was to put in a temporary tub and sink in the main bathroom.

Kevin called Iain regarding temporary tub/sink and suggested that Town and Country Give Kevin and Tara the money that they would have had to spend on a temporary tub and we would use said money to put in a tub in the basement bathroom. Iain agreed and said that he would credit us $400 towards the completion of our basement tub.

Met with Bob.
Bob explained that T&C was experiencing financial difficulties and not to give any money to them until stuff was done. T&C owed substantial amounts to Revenue Canada and would likely be folding soon. Likely Bob would bail him out and own the company on Monday.
He also told us that we would indeed not be ready to move in on the 26th (something we already knew based on the lack of progress on the building. He also confirmed that T&C was still going to pay the power bill. But to not get said bill until the house was actually done.

Drawer depth not being addressed yet, Iain will not sign off on getting paid until things are done. If we sign then we are saying house is 95% complete and that things will be done we have no assurances that they will in fact be done.
Feb 1st
Arranged to meet Iain along with a family friend who is a general contractor at the house at 6PM to discuss progress. And how to proceed.
Iain called at 5:35 to reschedule to 9AM on Saturday. Tara and Kevin still met with Rob.
Compiled a list of outstanding items that would need addressing.
Feb 2nd
Met with Building inspector at 9AM. As Iain was still insisting that we move in on Saturday we need a building inspection to occur prior to move in.
Building inspector failed the house on inspection due to lack of smoke detectors, Guard and handrails to the basement, Deadbolts on the doors, Kitchen ventilation and a complete lack of a finished bathroom.
After building inspector left Rob Lakeman, Iain, Tara and Kevin met and discussed the status of our house. After walking through the list Rob, Tara and Kevin developed the night before Iain was still maintaining that we would be able to move into the house next Saturday (Feb 9). After more discussion it was decided that Iain would have things done for the next Friday but we would meet again mid week to see how progress was going.

Leaky bathroom
Went to take a bath in the main bathroom tub after moving in.
Noticed that the jets were not functioning properly, chalked it up to bad jets on the tub. When I turned the jets off I heard a running water sound coming from the south part of the tub.
I immediately drained the tub and went downstairs to check if there was water dripping into the basement.
The water from the tub was leaking onto the electronic equipment in the basement (TV, DVD player, CD/stereo)
We immediately called Iain to report the leak.

Robert Lakeman arrived at our house to help with unpacking and to have a look at the leaking tub.
After looking for the access panel we did not find one. According to electrical code if there is a junction box for wiring it must be easily accessible for inspection.
One of the stipulations from the building inspector was that we have a viable bathroom and as Iain was not answering his cell phone, Rob and I decided that we needed to pull off the tub skirt in an attempt to fix the leak. After removing the skirt we noticed that the pump for the jets was not attached to the tub and was subsequently leaking water everywhere. We tightened this up, swept/vacumned all the gyprock dust that was in this area up and tested the watertightness of the tub. At this point we noticed that the drain also was leaking and fixed that as well.

Home builders plan investigation
Kevin talked to Charlene at the new home builders warranty program
She could find no record of our house ever being registered but was calling town and Country to verify. She stated that it is difficult to get the new home warranty insurance on a house that had already been moved into. The cost of registering a house with the new home warranty at the start would have been $840.
In order to get the warranty after move in Home Pro would need:
A letter from the home owner stating that there are no deficiencies.
A letter from the builder stating that the house had no deficiencies.

11:45ish Iain called back.
Kevin asked him if he had any news on the 10,000 lean on our house. He said that his lawyer was working to get ours removed and hopefully by Wednesday it should be gone.
Kevin also asked Iain about the fact that we were not registered with the new home warranty plan. He swore and was angry at a T&C employee that we were not registered yet and he would deal with it.
Kevin talked to Receptionist 3:02PM. Kevin asked her if she had been told not to register our house with the new home warranty program as she had hinted as such in a previous conversation with Tara.
She stated that “after Tara talked to her 2 weeks ago she looked into the home warranty status of our house and others. She talked to Iain and brought the fact that they were not registered yet to his attention.
The employee says that Iain stated "that we do not need to worry about Garratt's house because it is already complete"
There is signed documentation to that fact.
Feb 26th
Kevin talked to receptionist. She stated that Iain had done nothing to get the warranty in place on our house as far as she knew. Iain was not returning her calls and he did not answer when I called.
Iain called back at 4:35ish after I had left work and left a message that he was going to try me later.

Power bill arrives for 1369.23 which Iain has agreed to pay for (Signed a document with significant completion in order to get more of our money) Kevin sent Iain a copy of the bill asked how Iain is paying for it.

Tara talked to Iain. Iain is coming Thursday night right after the 9AM meeting with his lawyer.
March 13th
Lien #3 arrives for $7391.13
March 14th
Tara e-mails Iain as he is not answering calls and has advised that the best method of communication is e-mail. Tara informed Iain about the children’s birthday party at our house on Saturday March 15th and that temporary rails on our steps would not be acceptable.
Iain arrived late on Friday at our house after a town and country employee told him that she could not work for someone who deliberately endangered peoples lives.
Iain worked late until the rails were installed. He needed to use some lumber and tools that Kevin had to complete the job as he did not have the correct materials.
Kevin questioned Iain again about the missing house wrap. Iain stated that he would send someone out early the next week to get it completed.
Iain stayed for supper that night.

Iain said that he(above) should not say too much. “Iain is an honest man in a bad spot but he is doing his best to complete the work that he has committed to doing.”
Later on I hear he is going around telling people that he knows where there will be some cheap houses soon as the company is going bankrupt. I feel better knowing that an accountant who looked at Iain's books was just as stupid as we were.
March 27th Called and left message to ask whether or not Iain was coming to the 5:30 meeting that was scheduled.
March 28th Went to see Iain as he was not returning calls and Steve told us that Iain was no longer talking to us as we had involved a Lawyer. We told Iain that our lawyer was saying that we did not want to go lawyer to lawyer as this makes everyone lose.
March 29. Tara called Iain to ask what we were doing. Iain did not answer nor did he return the call.

They are willing to ship us the marble for 272.22 and roughly $100 for shipping if Iain is not picking it up.
Someone was apparently going to pick up some granite from the same place so maybe we can get him to pick ours up as well and save on shipping.

Was told that it made things harder because if Iain has no lawyer then our lawyer cannot talk to Iain directly.

Iain and Les met with us regarding discussing the list of outstanding items that our house required. Iain stated that they were committed to getting our house done and they were doing everything they could to make that happen. Iain made a list of all the big ticket items that were outstanding and all the liens that were on the house. He stated that if we give him enough money to pay off the liens plus the money for siding/AC... that he could get to work right away. Tara and I both told him that we would not be doing this. The lawyer and the bank agreed that no more money would be coming until the house was done. He asked us to talk to the bank and the lawyer and see if we could get money. He and Les were going to sit down with the list and determine what items they could start with that did not require much money. They would get back to us next week with timelines and a gameplan.

Kevin completed the wrapping around the kitchen doors. Upon removal of the brickmold it was apparent that the doors were not sealed properly.

May 1 Kevin called Iain and left a message asking him what was needed to get Iain to return a phone call? Tara and Kevin drove out to Edenwold to find Iain.
May 5. Tara e-mailed Iain to ask about the status of the completion of our house.
May 6 Iain e-mailed back that the game plan they had went out the window when Bob’s lien did not go away and that they could not give us a new plan.
June 6. Les and someone else came to our house to perform the backfilling that was required. They gave us 30 minutes notice in the morning that this was happening.They also piled all the garbage that is left (the previous garbage has been dealt with by Kevin and his father) in the middle of the yard.
June 8. Tara e-mails Iain again asking about the sit down meeting that was promised in April. The deadline for the AC install that was set on May 16 is past. If we do not have evidence from Iain that the AC install is underway immediately we will put it in ourselves and deduct the cost from our bill. Iain was informed that if there was no sit down meeting with him prior to July 2 that we will assume he has no intentions of completing the project and that we will proceed with things that need doing. Tara also questioned how and when the tub was being installed properly and when was it being fixed
June 10. Its raining in the basement again!
Kevin leaves message on Iain’s home number as no other phone is answered.
June 11. Kevin sends apology e-mail to Iain as the message should not have been on the home number.
June 16. Kevin receives an e-mail from Iain’s account claiming that it is not Iain but that Iain was in the hospital and will be back to work half days starting Wed the 18th of June. And that they will just delete this message as it is likely the reason Iain is in the hospital.
June 16. Kevin replies to the unknown author telling them that as he works in a hospital he knows how easy it is to check to see if someone was in, make sure it’s the truth if you are telling me he is/was in the hospital.
July 23. Called and left a message for The marble factory to call me back regarding the actuality of the warranty claim from our Jet pump. It was confirmed that the part was sent out earlier in the month.
June 27 Kevin sends a reminder e-mail to Iain that the July 2 deadline is looming and reminds him that the basement windows are still leaking.
June 28 Iain replies to e-mail stating that he has a product that will repair any leaks in the windows. He rambles about us paying for things twice and that he will send me documentation about the liens on the 29th.
June 30 Kevin e-mails Iain asking for proof that a lawyer is working on the liens. If nothing else give us the name of the lawyer.
July 3-July13 Kevin and Tara take a holiday
July 14th Kevin calls all known phone numbers in an attempt to get Iain to finish our house, but to let him know that we will be working on the outstanding things with notice to him to allow him the opportunity to work on it and not have it deducted from our bill.
July 25th
After coming home from work to disable the 7 smoke detectors that were all going off, I drove to Edenwold. I tried to call Iain on his 771-2138 and 771-4388 numbers. I again called the 4388 number from outside the door of the shop and watched Iain look at the number that was calling and go back to his desk.
Iain proceeded to explain that it was difficult to hear the phone in the shop. He also told me that the Lawyer (A family member in Edmonton) was working on getting rid of Bob's lien. He also stated that the forensic audit that was done showed that all accounts with the electrician were paid up which was contrary to what the electrician said when he was here fixing things that were not done to code.
I asked Iain to send me a copy of the stuff that was sent to the lawyer that he refused to name. I also asked to get a copy of the forensic audit. Iain promised he would get them out to me that day.
I also informed Iain that every time we felt the need to drive to Edenwold after he refused to answer the phone or call us back that it was going to cost him $100 unless he wanted to end the contract. I told him that we needed to meet with him to figure out how to figure out how to get our house done.
I also informed Iain that every week that went by and he did not bother to meet with us would cost him $50.
Also communicated was the fact that our time was valuable and that every missed appointment would cost $100. We were very tired of him ignoring us and treating like we did not matter.
Iain promised that Les would be out on Monday/Tuesday to fix the leaky windows and replace ALL of the smoke detectors to ensure that the defective one did not go off again.
he also stated that he would not miss any more meetings so my threats regarding paying for missed meetings was unnecessary. He would be at our house on the 28th later in the day.
Kevin asked about the status of our tub. When was the missing piece going to get here. Iain stated that they has just received it that morning and that Les would bring it with him when he came. Kevin insisted that he take it now. The postmark on the box was from July 11th expresspost (2-5 days)
I am guessing Iain found my demands funny as he had no intention of doing any more on our house.
July 29th Drove to Edenwold to discuss house with Iain after Iain did not show for the meeting. Meeting rescheduled for the 30th of July 2008 6:30
By 9:00 we had not heard from Iain
July 31.
After no response Via phone or e-mail we (Tara and Kevin) drove to Edenwold to try and speak to Iain regarding issues with the house. Iain was there as was Les. Les was coming out that afternoon to fix the windows which he did show up for. Iain promised that he would be at our house by 6:30 to meet with us and discuss the house issues... Iain called at 9:00PM to Cancel the 6:30 meeting he scheduled with us.
Rescheduled the meeting to Monday 4th after he gets home from Calgary with his sick child.
Les did show up and apply this wonderful product that Iain had purchased to fix our window problem. The wonder product. Tech Tape.
Kevin had a lengthy conversation with Les asking Les why he stays with a compulsive liar who does not pay people. Les commented that he saw an opportunity to get his hands on a cabinetry shop and change his profession to cabinet maker. He did not have time to fix the pump on the tub.
Aug 1 Raining in the house again.
We received about 6mm of rain and 4 windows were leaking. 771-4138 was called and a message was left regarding the persistent leak not being fixed.
Kevin fixes the tub 2 hours labour
Aug 2 Kevin removes the layers of tech tape. Removes the rubber seals and replaces them correctly (as correctly as he can providing that the housewrap is not installed properly in the first place.)
Aug 4.
No call from Iain to cancel the meeting
Aug 5 Iain called to reschedule the meeting to the 6th
Aug 6thTara and Kevin wait around for Iain until he no-shows.
Aug 7th
Tara schedules meeting with Iain for later in the afternoon on the 7th.
Kevin sends e-mail to Iain providing possible reasons why he can’t be bothered to call.
12:30 pm Iain called from the Woodwright Cabinet number
Iain said that he had been in a conference call for most of the morning and that the decision has been made to stop work on our home. Iain said that “Nigel” said that Ian should no longer deal with us. Iain said that Les told him that Kevin checked about his hospitalization and that this is not legal and that the privacy officer will be notified. Iain said that Kevin can not use his position in health care this way, and that this will be looked into. I said that asking which room someone is in, is not a breach of confidentiality. Iain said, “We’ll see.” Iain said that Kevin broke his confidence by talking to Les.
Iain said that there would be no more work done on our home. That there are people “far worse off” than we are, and that Kevin clearly does not want to work together. I said that Kevin did want to work together, but that he was angry about the three skipped meetings in one week and the smoke detectors that keep going off. Iain said that his health can not manage dealing with Kevin. Iain said that Kevin should not contact him any more.
Tara asked Iain if this meant that he is abandoning the contract and he said he was not certain but that a letter outlining everything would be coming from a lawyer. Ian said he did not know which lawyer as it would be up to Nigel. I asked Iain for Nigel’s last name. Iain said Nigel would not deal with us, so we could call him Nigel “Smith.” I said as this person is making decisions about our home, we should know who he is, but Iain said “No.”
Tara asked Iain what his plans were regarding the liens. He said he did not know, that this has been turned over to the lawyer. Again, he would not say which one.
Tara asked when we should receive this notification. Iain said he did not know and that everything is out of his hands. Iain stated that he is going away this weekend and that he may contact me again if he can get his blood pressure under control. Iain stated that any dealings we have are to be through me, and that he would not deal with Kevin in any way. Iain said that he may be able to give us information on how to get things done, but he was not certain.
