After discussing this with our new and inproved lawyer we have decided that it would be counter productive to sue Iain. It is going to cost on paper $75,000 over and above the holdback amounts to finish our house, hopefully we can do some of the owrk ourselves and settle some of the liens at a lesser amount making the amount outstanding less but there is no way we are going to walk away with a completed house for anything close to the contract price. I will let you decide if that is theft or not. It is my understanding that there are secured liens from Revenue Canada and banks against the shop totaling $148,271 there are also other liens that bring the total to $173,182.29. If any of you have seen his shop I am not sure it is worth the initial amounts. Did I mention that the village of Edenwold has an unspecified lien against the property as well. I wonder if this is because he did not pay for the lot up front or is it because he did not pay his taxes.
